Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Bokuju, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, do not use the app.

2. Description of Service

Bokuju is a mobile application that allows you to photograph wildlife and transform them into collectible cards featuring AI-generated sumi-e (Japanese ink painting) artwork. Features include card collection, cross-breeding, leveling, and real-time multiplayer battles.

3. License

Bokuju is licensed, not sold, to you. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the app on any device that you own or control, as permitted by the usage rules of the Apple App Store or Google Play Store (collectively, the "App Stores").

4. User Accounts

• You must provide accurate information when creating an account
• You are responsible for maintaining the security of your account
• You must be at least 13 years old to use Bokuju
• One account per person; do not share account credentials
• You may delete your account at any time through the app settings

5. In-App Purchases & Daku Credits

Daku is Bokuju's in-app virtual currency used for capturing creatures, cross-breeding, and other features. Daku credits are available for purchase as consumable in-app purchases.

• New accounts receive a small number of free starter credits
• Additional credits can be purchased through the app via in-app purchases processed by the Apple App Store or Google Play Store
• All purchases are charged to your Apple ID or Google account and are processed by the respective App Store, not by Bokuju directly
• All purchases are final and non-refundable, except as required by applicable law or the refund policies of the Apple App Store or Google Play Store
• To request a refund, you must contact Apple or Google directly through their respective support channels, as we do not have the ability to process refunds for App Store or Play Store purchases
• Daku credits have no real-world monetary value and cannot be exchanged for cash
• Credits are non-transferable between accounts
• We reserve the right to modify pricing at any time
• Unused credits may be forfeited upon account termination for violations of these terms

6. User Content & Photos

You retain ownership of photos you take. By using Bokuju, you grant us a limited license to:

• Process your photos through AI to identify creatures
• Generate and store card artwork based on your photos
• Display your cards in public galleries or battles (if you choose to participate)

You represent that you have the right to photograph subjects you capture and that your content does not violate any laws or third-party rights.

7. AI-Generated Content

Bokuju uses artificial intelligence to identify creatures and generate card artwork, names, descriptions, and battle moves. You acknowledge that:

• AI identification may not always be accurate; results are for entertainment purposes
• Generated artwork and text are unique creations based on your photos
• We do not guarantee any specific outcome from AI generation
• Artwork may contain stylistic variations, anatomical inaccuracies, or unexpected interpretations - this is inherent to AI art generation
• AI-generated content should not be relied upon for scientific or educational identification

Refund policy: Credits are only refunded when there is a technical failure in the generation process (e.g., the system fails to produce any result). Dissatisfaction with the visual style, accuracy, or artistic interpretation of successfully generated content does not qualify for a refund. Each generation is unique and non-reproducible.

8. Acceptable Use

You agree not to:

• Upload photos of humans, offensive content, or copyrighted material
• Submit drawings, screenshots, or non-photographic images as captures
• Attempt to exploit bugs, glitches, or manipulate game systems
• Use automated tools, bots, scripts, or modified clients
• Harass other users or engage in abusive behavior in battles
• Reverse engineer, decompile, or attempt to extract source code
• Create multiple accounts to abuse free credits or promotions
• Sell, trade, or transfer accounts or in-app items for real money

9. Multiplayer Features

Bokuju offers real-time multiplayer battles. You are responsible for your conduct during battles. We reserve the right to suspend or terminate accounts that engage in unsportsmanlike behavior, cheating, or harassment. Battle results are final and cannot be disputed.

10. Service Availability

We strive to keep Bokuju available but do not guarantee uninterrupted access. The service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We may also impose rate limits on certain features to ensure fair usage and system stability.

11. Termination

We may suspend or terminate your account at any time for violation of these terms or for any other reason at our discretion. Upon termination, you lose access to your account, cards, and any purchased Daku credits. You may also terminate your account at any time through the app settings.

12. Disclaimer of Warranties

Bokuju is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the service will be uninterrupted, error-free, secure, or that AI-generated content will be accurate or suitable for any particular purpose.

13. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Bokuju, including but not limited to loss of data, loss of credits, or inability to access the service.

14. Changes to Terms

We may update these terms at any time. We will notify users of material changes via the app or email. Continued use of Bokuju after changes constitutes acceptance of the new terms. If you do not agree to updated terms, you should stop using the app.

15. Governing Law

These terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these terms or your use of Bokuju shall be resolved through good-faith negotiation or, if necessary, binding arbitration.

16. App Store Terms & Third-Party Beneficiaries

If you downloaded Bokuju from the Apple App Store or Google Play Store, the following additional terms apply:

• These Terms are between you and BUDGEFROWNIE LTD only, and not with Apple Inc., Google LLC, or any other app store provider
• Apple, Google, and their subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you
• The app store provider has no obligation to provide maintenance or support services for Bokuju
• The app store provider is not responsible for addressing any claims by you or any third party relating to the app, including product liability claims, any claim that the app fails to conform to applicable legal or regulatory requirements, and claims arising under consumer protection or similar legislation
• In the event of any failure of the app to conform to any applicable warranty, you may notify the app store provider, and they may refund the purchase price (if any) of the app; to the maximum extent permitted by applicable law, the app store provider has no other warranty obligation with respect to the app
• The app store provider is not responsible for the investigation, defence, settlement, or discharge of any intellectual property infringement claim
• You represent and warrant that you are not located in a country subject to a U.S. Government embargo and that you are not listed on any U.S. Government list of prohibited or restricted parties
• You must comply with all applicable third-party terms of agreement when using the app (e.g., your wireless data service agreement)
